Eyefootage Terms and Conditions

Welcome to Eyefootage, a specialized video-sharing platform (“Platform”) where you can upload and monetize footage for insurance and legal evidence. By accessing the Platform and/or Eyefootage website (collectively, the "Site"), using our services, or submitting content, you agree to comply with and be bound by the following Terms of Service. These terms govern the relationship between Eyefootage and contributors (“Contributors”) and customers (“Customers and collectively with Contributors, "Users" and Eyefootage regarding the submission, use, and licensing of evidentiary footage including any additional information (e.g., documentation, metadata, collectively, the “Content”).

1. Zero-Tolerance Policy: AI and Altered Media

The integrity of the Platform is paramount. Any submission of Content that has been generated, modified, or enhanced by Artificial Intelligence (AI), including but not limited to "deepfakes," generative fill, or structural alterations, is strictly prohibited.

  • Mandatory Ban: Any Contributor found to be uploading AI-generated or synthetically altered Content will be subject to an immediate and permanent ban from the Platform.
  • Legal Referral: Because Eyefootage is used for insurance claims and legal proceedings, the submission of altered Content may constitute insurance fraud or perjury. Eyefootage reserves the right to report such activity and provide such Content to law enforcement and insurance fraud bureaus.
  • Forensic Review: All submissions are subject to automated and manual forensic analysis to verify authenticity.

2. No Duty to Monitor & Accuracy of Evidence

Eyefootage has no obligation to verify, warrant, or vouch for the accuracy, forensic integrity, or quality of the Content. .

  • Inherent Risk: The use of internet-based platforms carries inherent risks. Customers—must exercise their own best professional judgment when relying on information obtained from the Content or the Platform.
  • Third-Party Responsibility: Eyefootage bears no responsibility for Content uploaded by third parties, regardless of whether that Content is inaccurate, unsuitable, or misleading.
  • Right to Monitor: We reserve the right to monitor any information transmitted through the Site for operational, security, or verification purposes. Use of the Site constitutes consent to such monitoring. We further reserve the right to remove any materials that, in our sole discretion, are objectionable or violate these Terms.

3. Content Submissions & Forensic Integrity

By uploading or submitting Content, a Contributor represents and warrants that:

  • It owns or controls all rights to the Content.
  • The Content is a raw, unedited, and authentic recording of a real-world event. No elements within the Content have been added, removed, or modified via digital editing software or AI tools.
  • You have the necessary authorizations and approvals to share the Content for the Purpose, as defined below, including the depiction of any property or individuals within the Content and any incident or accident shown in the Content.
  • You have complied with all applicable laws in collecting the Content.

4. Acceptability Guidelines for Contributors

Contributors shall not post, upload, or submit Content which violates applicable law or includes any of the following:

  • AI-generated content or "Deepfakes."
  • Invasions of privacy unrelated to the documentation of a public incident or accident.
  • Gratuitous violence or physical abuse outside the scope of documenting an insurance or legal event.
  • Defamation, slander, or libel.
  • Intentional fraudulent or misleading content (e.g., staged or digitally fabricated accidents).
  • Pornographic, lewd, or sexually explicit content.
  • Content intended solely to disgust or shock rather than serve as evidence.
Failure to comply will result in the immediate removal of Content and potential termination of access to the Site.

5. Monetization & User Conduct

Subject to Section 6 below, Contributors authorize Eyefootage to monetize your Content to include selling access to or downloads of your Content for informational, evaluation, legal/insurance claims purposes and for any other purposes permitted under applicable law (collectively, the “Purpose”).

  • Revenue Sharing: You agree to receive One Hundred Fifty Dollars ($150) from each sale of your Content.
  • Fees: Customers accessing the site agree that Eyefootage may charge reasonable subscription fees for accessing or downloading Content, regardless of whether the footage is ultimately used in a court of law.

6. Ownership and Grant of Rights

Contributors retain ownership rights to the Content upload. However, by uploading footage, Contributors grant Eyefootage an exclusive, worldwide, sublicensable, and irrevocable license to use, reproduce, distribute, and provide the Content to third-party insurance carriers, law firms, and other entities for the Purpose.

Contributors represent and warrant that the Content is original and you have the right to grant this license. Contributors have obtained necessary consent from identifiable persons, or the Content was captured in a public place where there is no reasonable expectation of privacy, for the purpose of documenting a factual occurrence.

7. Account Security & Termination

  • Security: Contributors and Customers are are responsible for maintaining the security of your account credentials. You agree not to share your password or access to your account with anyone else.
  • Termination: We reserve the right to terminate or suspend your access to Eyefootage, the Site or the Platform at any time for any reason, including but not limited to violations of these Terms and Conditions.

8. Legal Provisions

  • Disclaimer of Warranties: Eyefootage is provided on an "as is" and "as available" basis. We do not make any warranties regarding the availability, reliability, or security of the Platform or the Site. Customers are using the Content and the Site at their own risk.
  • Limitation of Liability: To the extent permitted by law, Eyefootage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill resulting from your use of the platform.
  • Indemnity: You agree to indemnify and hold Eyefootage harmless from and against any and all claims, liabilities, and expenses (including reasonable attorney’s fees) arising out of your violations of these Terms of Conditions, unauthorized use of Content or the submission of fraudulent/altered media.
  • Commercial Exploitation: The Content is for internal use. Commercial use, public broadcast, or entertainment-based exploitation of Content is prohibited without an executed license agreement from Eyefootage.
  • Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Pennsylvania, without regard to its conflict of law principles. Any action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Philadelphia, Pennsylvania.
  • Disclaimer of Endorsement: Eyefootage does not endorse any Content or any information, opinion, recommendation, or advice expressed therein.

Eyefootage reserves the right to modify these Terms and Conditions at any time. You should check these Terms and Conditions periodically for changes. By continuing to use the Site or Platform after we post any such changes, you accept the Terms and Conditions as modified.

9. Contact Us and Privacy Removal Requests

Content Removal Notice: Eyefootage respects the privacy and data rights of individuals. If you are an individual depicted in any Content hosted on the platform, or if your identifiable property (such as a license plate) is shown, you may submit a "Privacy Removal Request" to support@eyefootage.com.

Request Requirements: To be considered, a Privacy Removal Request must include:

  • (a) The specific URL or Content ID;
  • (b) The precise timestamp(s) where the identifiable person or property appears;
  • (c) Proof of identity or ownership of the property in question; and
  • (d) The specific basis for the request.

Redaction vs. Removal: Upon receipt of a valid request, the Company will review the Content in accordance with its internal privacy policies and applicable law. Because the Content often serves a critical forensic purpose for insurance claims and legal investigations, the Company reserves the right to satisfy a request by blurring, masking, or otherwise redacting the identifiable portion of the footage rather than removing the Content in its entirety.

Legitimate Interests: The Company may decline a removal or redaction request where the Content is currently being used in an active insurance claim, legal proceeding, or where the preservation of such evidence is required by law or serves a substantial legitimate interest.

By using the Site and the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
